  Sales Contract and Guarantee

This sale of the M/F Siberian Husky named_________________________________

Is made upon the following terms and conditions as agreed to by
Dorothea and Larry Sanders, hereafter referred as seller, and
__________________________________________________________________,
Hereafter referred to as buyer, this the _____ day of _______, 20___.
1. The above named dog is a pure bred Siberian Husky, register able with the
------- and the -------).
a. The price of $ ________ is to be paid immediately upon the purchase of the above named Siberian Husky, hereafter referred to as dog. Should payments be made the agreement shall be written as addendum A to this contract and initialed by buyer and seller.  If the dog is to be shipped to the buyer all arrangements will be made by the seller,transport to Airport, crate and shipping charges will be in addition to the sales price as outlined in addendum B and initialed by both buyer and seller.
2. Buyer agrees to have dog cleared by their own licensed veterinarian within 3 working days of purchase to ensure that dog is normal and healthy. Sellers’ responsibility for communicable disease is void if not reported within 5 days of purchase. Upon oral conformation of any genetic problem from examining vet, dog may be returned to breeder/seller within 5 working days of notification, for dog of equal value or full refund of purchase price. Replacement/refund is contingent on dog being returned to seller in the same condition that it left seller's property, and with a written explanation by the buyer's licensed Veterinarian of choice. Expense of returning dog to breeder/seller is the sole responsibility of the buyer.
3. Buyer agrees to provide routine care of dog, which must include a licensed
veterinarian recommended immunization and health care program, with
preventative heart worm medication included. Dog should be kept parasite free as possible. Buyer must, also, provide a proper environment that is: food of sufficient quality and quantity to keep dog in optimum condition, clean water, adequate shade and shelter to protect from elements, with a fenced in yard and adequate exercise. Under NO circumstances may dog be allowed to run unsupervised in a non-fenced area.
4. If the original buyer cannot keep dog, for any reason, buyer must notify
seller in writing, via U.S. Postal Service, certified mail, of their intentions.
Breeder/seller will choose to either house the dog at the buyers expense, until a home is found, or assist buyer in interviewing/screening new owners for dog. Under NO circumstances shall dog be surrendered to an Animal Shelter, sold/ given to a pet store, or pet dealer for re -sale, or sold to any animal testing/research facility.
5. Buyer and seller have read, and fully understand, and are in agreement with all the terms and conditions of this contract. Any other agreements or
amendments to this contract will be written and initialed by both parties. Failure to comply with any of these clauses entitles seller to repossession of the dog with its ----Registration Certificates, signed by buyer, and further, punitive damages for up to $2500.00 and all legal fees incurred. Court proceedings shall take place in the county of the seller, and possession of dog must be returned to the seller until dispute is settled. This is solely for the protection of the dog, and shall be enforced, particularly in the case of abuse or neglect of the dog.

Addendum A to ---------Sale Contract and Guarantee
  1. The buyer agrees to pay a nonrefundable deposit of $250.00 to hold the puppy of their choice, the balance of $__________  is to be paid in full when dog is six weeks old on the ________ day of ________, 20___.  If Balance is not paid by this date the buyer has five days to make payment or the deposit is forfeited and the dog will be offered for sale to other buyers.

Addendum C to Sales Contract

CONTRACT OF SALE

These conditions and requirements must be agreed to as part of the CONTRACT OF SALE signed by the Buyer (s) and Seller for the purchase of a wolf hybrid or other animal from  Polar Point Husky KENNEL

l. Buyer will provide a secure and comfortable pen or yard area, MINIMUM size of 25’X25’, with no more than two animals being kept in this size area at any one time. Fencing must be strong and secure enough to prevent escape. Fencing will be minimum of 6’ in height. If this height is not sufficient to prevent the animal(s) from escaping, the fencing will be hot-wired, and overhang, roof or more height will be added. (This is strongly advised as soon as the fencing is erected so the animal never learns to escape.) Secure ground wire will be attached on the inside around the bottom of the fence or the pen will be floored in some other way to prevent digging out.

2. The animal will not be restrained on a chain or tie-out except in an emergency or VERY temporary basis.

3. The animal will have either companionship from humans for at least two hours on a daily basis or will have a compatible canine companion at all times. (Both are preferable.)

4. A shaded area and good shelter dry within under normal weather conditions, and large enough to adequately house all animals will be provided within the pen area.

5. Nutritious food will be provided in sufficient quantities for the size and age of the animal daily. Fresh water will be available at all times. All medical vaccinations will be kept current and any other veterinary care provided that is deemed necessary to keep the animal in good health.

6. The pen area will be cleaned of droppings on a daily basis. Any debris that may be injurious to the animal will be removed immediately.

7. All pups must be spayed or neutered by the age of one year. This requirement is waived if the Seller and Buyer agree to the following terms and sign the waiver.

A. A female pup must not be bred until she is at least twenty months of age.

B. The buyer agrees to accurately represent the percentage of wolf of both the animal purchased and the offspring produced from this animal to the best of his/her knowledge.

C. The Buyer agrees to breed the pup to non-aggressive dog breeds or wolf hybrids of proven background and percentage. By signing, Buyer agrees to the above conditions in part 7.

D. The Seller reserves the right to examine and approve any mate that is to be bred with this animal prior to time of breeding. The Buyer may not breed this animal without the written consent of Seller.

8. If a waiver is not granted, Seller must receive a certification from a veterinarian by the age of one year that the pup has been spayed or neutered or all registries will be notified not to accept any animals produced by this pup. Failure to comply with this agreement will void this contract and gives the Seller the right to repossess the pup.

9. The Seller maintains the right to inspect the animal at his new (Buyer’s) home. The Seller or his designated agent may do this.

10. If the animal has to be given up for ANY reason, the Seller must be notified first. The Seller has first "Right of Refusal" to the pup. If another home is to be considered, the Seller must agree to the choice of home before the animal can be placed.

11. A firm but kind training will be provided for the pup at every stage of it’s development. Training of all canines is encouraged. However, an understanding of the animal and its limitations and trainability must be understood. The animal will not be placed with someone else for training. The animal and Buyer will work together in all training efforts.

12. Direct supervision by an adult will be provided during any and all contact between children and the animal. (This is an important rule to follow when dealing with any dog as the animal may accidentally harm the child with rough play or may miss-read the child’s actions as threatening.)

13. The animal being purchased is guaranteed to be free of major congenital defects such as hip dysplasia or chondroyplasia. Should any serious congenital defect appear as the animal matures, the Buyer must provide accurate documentation from a licensed veterinarian of such to the Seller and claims of such must be made in writing within two years from date of purchase. Replacement of defective animal will be made on agreement of both parties. An animal for which a replacement is made may be euthanized, returned to Seller or left with the Buyer. The Seller and the Buyer will make the decision. If the Buyer wishes to keep the animal for which a replacement is made, the Seller will require the original animal to be spayed or neutered and proof of same provided to the Seller before replacement is made.

14. It is hereby understood and agreed by the undersigned that he/she, in consideration of  Polar Point Husky KENNELS, their agents or employees, selling said animal (s) to the undersigned Buyer (s), he /she does hereby release, acquit and forever discharge  Polar Point Husky KENNELS, their agents or employees of, and from any and all actions, causes of action, claims, demands, damages costs, loss of services, expenses and compensation, on account of, or in any way growing out of, any and all known or unknown bodily injuries and property damages resulting, or to result from the ownership of the animal (s) purchased from  Polar Point Husky KENNELS, their agents or employees, at any time, now or hereafter; and further agrees that they will defend and guarantee any damages assessed the said (Name KENNELS, their agents or employees resulting from the violation of this agreement on the part of the undersigned Buyer (s).

15. This contract of sale and release of liability contains the entire agreement between the parties hereto, and the terms of this agreement are contractual and not a mere recital.

16. I/We further state that I/we have carefully read the foregoing and know the contents thereof and I/we sign this CONTRACT OF SALE of my/our own free will.

We look to match our puppies with loving homes that are both knowledgeable about and ready to care for a Siberian Husky.  Our prices range from $400 to $1000. All of our litters are ---- registered. Our puppies come with a veterinarian examination, health certificate, and 72 hour health guarantee.  They will have been on a strict worming and vaccination schedule and a copy of this will be given to you for your records. Buyer pays for Vet visit and certificate and Grate 
 Our puppies will go to their new homes afer they eight weeks of age or when the individual puppy is ready.  We ship within the D/Fort Worth Airport, Tx.  Shipping is an additional $  ??.00 plus our delivery charge to the airport.($150.00) Your new puppy will arrive in its own cedar chip lined crate, with its registration certificates, health certificate, water bowl, Puppy Kit and toy. ( Shipping cost may change depending on Oil prices)
 
 

Deposits

We will hold the puppy of your choice with a nonrefundable $250.00 deposit.  The signed Sales contract is due within one week of placing a deposit.  The remaining balance must be paid by the time puppy is six weeks old, this includes both shipping charges and remaining balance due on the puppy.  Failure to pay the balance by the agreed upon date will result in the cancellation of the sales contract and forfeiture of your deposit.  In this instance the puppy will be offered to other buyers.
